Terms of Service

1. Who you are contracting with

This site and the material sold on it are operated by [LEGAL ENTITY NAME], a company registered in Romania, registered office [REGISTERED ADDRESS, ROMANIA], trade register number [J__/____/____], tax identification code [CUI] ("we", "us"). You can reach us at max@promisephones.com.

Payments are processed by Dodo Payments, acting as merchant of record. Dodo is the seller of record for your transaction and its own terms apply to the payment itself.

2. What you are buying

A subscription giving you access, for as long as it stays active, to written course material, a costing spreadsheet, and updates we choose to publish. You are buying access to material, not a result, not a service, and not ongoing personal consulting.

We may add, change, or remove material at any time. We do not promise any particular lesson, feature, or update will exist or continue to exist.

3. Subscriptions, billing and cancellation

• Subscriptions renew automatically at the interval you selected until cancelled.
• You can cancel at any time from your account. Cancellation stops future billing.
• After cancelling, access continues until the end of the period you have already paid for.
• If a renewal payment fails, access continues for a short grace period so you can update your payment method, after which it ends.
• Prices may change. Any change applies from your next billing period, and we will tell you before it takes effect.

Refunds are covered separately in our Refund Policy, which forms part of these terms.

4. Your licence, and what you may not do

We grant you a personal, non-exclusive, non-transferable, revocable licence to access the material for your own use while your subscription is active.

You may not copy, republish, resell, sublicense, share your login, or distribute the material in whole or in part, and you may not use it to build a competing product. Sharing account credentials is grounds for termination without refund.

5. No advice, no recommendation, no guarantee

We do not recommend that you undertake any activity described in the material. It is a description of what one person did during a particular period, under particular conditions, provided for information only.

• No earnings promise. Any figures we publish are our own past results. They are not typical, not projections, and not a representation of what you will earn. Most people who buy material like this earn little or nothing.
• No financial, tax, legal or investment advice. Nothing here is advice of any kind. Consult a qualified professional before making financial decisions.
• No suitability assessment. We know nothing about your circumstances and have not assessed whether any of this is appropriate for you.
• You may lose money. Money you spend on devices, services, subscriptions or anything else is at your own risk and may not be recovered.

6. Third-party platforms are your responsibility

The material discusses services operated by third parties. Those services have their own terms, which change without notice and which we neither control nor monitor.

You are solely responsible for reading and complying with the terms of every third-party service you use. We do not warrant that any activity described in the material complies with any platform's terms, with your local law, or with any tax obligation you may have. You accept that accounts may be suspended, earnings withheld, or access revoked by those platforms, and that we have no responsibility for that and will not compensate you for it.

You agree not to use the material to do anything unlawful, fraudulent, or deceptive.

7. Accounts and access

You sign in using a link sent to your email address. Keep access to that mailbox secure. You are responsible for activity on your account. Tell us promptly if you believe it has been compromised.

8. Termination

You may stop using the service at any time by cancelling. We may suspend or terminate your access if you breach these terms, share credentials, initiate a fraudulent chargeback, or use the material unlawfully. Where we terminate for breach, no refund is due.

9. Disclaimer of warranties

To the fullest extent permitted by law, the service and material are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or that the material is current, complete, or uninterrupted.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for lost profits, lost earnings, lost data, lost opportunity, or any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the material.

Our total aggregate liability to you for any claim is limited to the amount you actually paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

11. Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms, your unlawful conduct, or your breach of a third-party platform's terms.

12. Changes to these terms

We may update these terms. Material changes will be notified by email or on this page before they take effect. Continuing to use the service after that constitutes acceptance.

13. Governing law

These terms are governed by Romanian law, and the Romanian courts have jurisdiction.

This does not take away your local consumer rights. Where you buy as a consumer, a choice of law cannot deprive you of the protections of the mandatory law of your country of residence. If you are in the United States, that includes the consumer protection law of your state, and you may bring proceedings there. If you are in the EU, you keep the mandatory protections of your member state.

We sell to buyers in the United States. Our subscription terms are intended to comply with the Restore Online Shoppers' Confidence Act and with state automatic-renewal laws, including California's, which require clear disclosure of renewal terms before purchase and a cancellation route as easy as sign-up. The disclosure in section 3 and the in-account cancellation are how we meet that.
